2007 – MDOT to Increase Labor Compliance Oversight

Prevailing Wage

MDOT will be increasing wage rate interviews during the 2007 construction season. Efforts will be made to insure that contractors are complying with all requirements as specified in the prevailing wage contract documents. Third party personnel may assist MDOT with these interviews.

Remember, the prime contractor is ultimately responsible for subcontractor compliance.

Prompt Pay

MDOT will increase focus on the requirements set forth in the Special Provision for Prompt Payment, which states:

“The prime contractor must pay each subcontractor for all satisfactory completed work associated with subcontract no later than 10 calendar days from the receipt of each payment the prime Contractor receives from the department.”

Statement of DBE Subcontractor Payments

Emphasis will be placed on the submission of MDOT form 0164, “Prime Contractor Statement of DBE Subcontractor Payments”. Submittal to MDOT must be within 20 days of the end of the quarter, 60 days after project completion, and 20 days after the engineer’s submission of the final payment estimate.
