The Michigan Department of Transportation (MDOT) recently posted a “Contractor Announcement” for the clarification of flag person wages. This clarification that affects the February 6, 11, 12, March 6, and April 3, 8, 2015 lettings states the following:
Prime contractors are hereby notified of a conflict in wage documents issued for the above bid lettings. The MI150001 wage decision used since the February 6, 2015, bid letting contains a statement regarding Executive Order 13658 which establishes a minimum wage of $10.10 on all contracts subject to the Davis-Bacon Act. MDOT issued an addendum for each of these bid lettings indicating the Flag Person wage rate to be $8.15. This addendum should not have been issued as the Executive Order takes precedence over the MDOT addendum.
Please be advised that all contractors, prime contractors and subcontractors, must pay the Flag Person wage rate of $10.10 on any executed contracts from the above bid lettings.
