MDOT Implements DBE “Data Collection Process”

Beginning with the October 4, 2013, bid letting, all projects with aDBE participation goal of 6% or greater will include new contract provisions for MDOT’s “Data Collection Process”.

Modeled off previous “DBE information at time of bid” pilot programs implemented in 2011 and 2012, the primary purposes of this process are to collect subcontractor work classification and quotation information that supports the project DBE participation goal and to collect DBE subcontractor quotation activity information.

Unlike the previous pilot programs that required the submittal of DBE information at the time of the electronic bid submittal, this data collection process requires that:

  • by 2:00 PM on the day of the bid letting, the three lowest “as-submitted” bidders must submit all subcontractor work classification and quotation information that supports the project DBE participation goal
  • by 2:00 PM on the day of the bid letting, all DBE subcontractors that quoted the three lowest “as-submitted bidders must submit their quotation information

Like the previous pilot programs this data collection process requires that within three business days of the bid letting, or of release from TBA status, the confirmed low bidder must submit their signed “blue sheets”. If the DBE participation goal is not met, the submittal must include the confirmed low bidder’s Good Faith Effort Application and GFE documentation.

Also like the previous pilot programs, this Data Collection Process establishes specific actions and expedited timeframes for the DBE goal modification or waiver process.

Specific MDOT forms have been developed for all of the required submittals.

Bidders who fail to submit the required documentation within the specified timeframes will be deemed to have submitted an irregular bid and their bid will be rejected.

This Data Collection Process has been vetted through the MITA/MDOT DBE Committee.

At the time of this writing MITA is aware that the proposals for Items 001, 002, 003, and 020 in the October 4th bid letting include the Special Provision for Data Collection Process.
