MDOT Implements “E-Verify” Requirement

When MDOT’s budget bill (PA 200 of 2012) was signed into law in June by Governor Snyder it included the new requirement that all pre-qualified contractors use the E-Verify system to validate the legality of new-hires to work in the United States.  Specifically the law states, “The department shall require as a condition of each contract or subcontract for construction, maintenance, or engineering services that the prequalified contractor or prequalified subcontractor agree to use the E-Verify system to verify that all persons hired during the contract term by the contractor or subcontractor are legally present and authorized to work in the United States.”

E-Verify is an internet-based system operated by the Department of Homeland Security in partnership with the Social Security Administration.  The system allows an employer to determine the eligibility of new employees to work in the United States using information reported on the employee’s Form I-9.

 

Effective with the November letting, MDOT will be including a supplemental specification in each project proposal describing the E-verify requirements. Click here to view the Supplemental Specification for E-Verify.

Additionally, MDOT has added a certification statement to the “Authorization for Verification and Affidavit” section, in the Construction Pre-qualification Application.  The added certification states that the applicant has/will use the E-Verify system. MDOT will verify the contractors’ use of E-Verify as a part of their random reviews of subcontract information.
