Earlier this year, the Michigan Department of Transportation instructed its staff and representatives to stop signing waste profile forms issued by landfills. This directive stems from concerns raised by the state attorney general regarding indemnification clauses in many of these forms, which state agencies are unable to sign. The department will be issuing formal guidance with changes to the Construction Manual and Specifications, directing contractors to sign these landfill-generated forms to complete the disposal process.
At MITA’s request, to ensure contractor risks remain clear and unchanged due to this new direction, the department has made available the following material disposal forms for use by contractors:
1096 Disposal of Non-Hazardous Material
1095 Disposal of Hazardous Material
We highly recommend that contractors use these forms wherever appropriate and maintain them in their company’s project records. Another bulletin will follow once the department issues final guidance and changes to the Construction Manual and Specifications have occurred.
