Earlier this week, FHWA released guidance for its Division Offices and state DOTs to comply with a recent preliminary injunction in the Mid-America Milling case, in which two industry plaintiffs are challenging the constitutionality of the DBE program. The FHWA Memorandum can be found here.
MDOT has already begun complying with the guidance and has been updating project “Required DBE Participation Goals” accordingly.
