Traffic Control Quality and Compliance

It has come to our attention that some owner agencies are not complying with the MDOT Special Provision for Traffic Control Quality and Compliance and have threatened to issue fines (negative contract price adjustment) if work is not completed in a 4 hour time period.

There are two parts to the SP and both are very clear on their requirements. For traffic control not anticipated in design, the Engineer will provide written instructions to the Contractor and the Contractor is to develop and submit a written plan to the Engineer. For as designed traffic control, the Engineer will provide written notification to the Contractor for the corrective action and the Contractor has four hour time period to correct the traffic control.

However, if the traffic control cannot be corrected within the four hour time period, the Contractor must develop a written implementation schedule for the corrective action and submit the schedule to the Engineer for approval within one hour of receiving the written notification.

If the corrective action cannot be completed within the four-hour window, and a response is provided to and approved by the Engineer, the intent of the SP has been satisfied and no violations have been made. If corrective actions are not completed per the schedule proposed by the contractor and approved by the engineers, a violation and the associated fines may be imposed.
