Updated “Truck Driver Scenario” Guidance Document

MITA recently met with the Michigan Department of Labor and Economic Growth (DLEG) to discuss ongoing state prevailing wage truck driver enforcement concerns. During the meeting, DLEG indicated that it was now their position that “owner-operators” would be covered under the Michigan Prevailing Wage Act when they are working on the physical place or places where the building or work will remain. Subsequent to that meeting, DLEG further informed MITA that it was also their position that “broker trucking” would also be covered under the MI Prevailing Wage Act.

Although MITA disagrees with DLEGs recent change in position relative to the “owner-operated” and “broker trucking” scenarios, we are updating our published “Truck Driver Scenario” Guidance Document to reflect those changes. MITA will continue to pursue this issue in an effort to ensure that Public Act 166 is interpreted and enforced in its intended manner and to ensure reasonable level of consistency is maintained in the way truck drivers are viewed with respect to federal or state prevailing wage.
