In a recent bulletin, we shared news about a new state project registration requirement going into effect for state-funded projects, which include state prevailing wage. Several members have since brought to our attention many insightful questions. MITA has been collaborating with LEO to gather additional details to support our members in meeting this new requirement and to help LEO avoid any unnecessary implementation practices that could be detrimental to industry business on state-funded projects. Below are a few key updates we’ve received since the requirement took effect that you should be aware of.
1. The current process. Contractors and their subs are directed to fill out an application form found here. After completing the form, they should receive an invoice and certificate of registration.
2. Some of this new process is interim. Because LEO was required to have the registration up and running by April of this year, the department was forced to have some temporary processes in place before more permanent solutions could be implemented. LEO intends for a more permanent registration process to be in effect in April 2026. Full details of what exactly will be changed are still unclear, but it will likely be related to an updated application form, automatic payment methods, and quicker registration confirmation retrievals.
3. MITA requests registration list. The task of confirming subcontractor registration on state-funded projects is important to ensuring bids remain eligible for award. LEO currently has this confirmation coming through an email process. After MITA’s request, LEO plans to have an online list where registration can be verified to help bidding teams make timely decisions. We will share updates about this list as we receive them. In the meantime, confirmation of subcontractor registration can be verified by asking subs to include the registration confirmation with their bid or by emailing LEO-WHCertifiedPayroll@michigan.gov
4. LCP Tracker. Another requirement of the state prevailing wage act is for contractors to submit payrolls to LEO on state-funded projects. LEO has chosen to use LCP tracker for this purpose. We are told that those already registered with LCP tracker will not have to create another account with LCP tracker but can send LEO their existing account information. Additionally, for state-funded projects administered by MDOT, the payroll information LEO requires should be sent to them by MDOT.
According to the act, this registration should only be required when the contractor and subcontractor employ construction mechanics, where prevailing wages would apply as defined in the act. However, we have heard from service providers and others that some state agencies are asking them to complete this registration. We anticipate LEO will provide more clarity to other agencies and other parties on how this registration should be applied in those cases.
