MDOT’s Construction Field Services Division (CFS) has issued guidance for the conduct of Dispute Review Board (DRB) meetings on those projects where the DRB meetings are required by the incorporated Special Provision for Dispute Review Board. The CFS guidance is as follows:
“In accordance with Gov. Gretchen Whitmer and the Michigan Department of Health and Human Services’ recommendations designed to help prevent the spread of Coronavirus Disease 2019 (COVID-19), MDOT and CFS supports and recommends the use of conference lines and call-in attendance for conducting DRB progress meetings for the foreseeable future. There should be no adjustments to DRB member payments and compensation at this time for call-in attendance. DRB Progress meeting schedules and frequency can be adjusted to better suit the project as appropriate – for example, bi-monthly meetings.
If absolutely necessary, DRB Hearings and advisory opinions may be conducted in-person with physical attendance, but these should be limited and only occur if there is no possibility that an electronic or telephonic alternative is available. An increased flexibility with dates, timelines, and accommodations should be afforded and considered.
The state is taking proactive steps to mitigate the spread of COVID-19 in Michigan. We appreciate your understanding and cooperation in reducing the coronavirus risk to Michigan residents.
